SPONSOR AND ADMINISTRATOR: The sponsor of this WYNDHAM REWARDS POINTS GIVEAWAY (‘Sweepstakes”) is Wyndham Hotel Group, LLC, 22 Sylvan Way, Parsippany, NJ 07054 (the “Sponsor”), and the administrator of the Sweepstakes is Don Jagoda Associates, 100 Marcus Drive, Melville, NY 11747 (“Administrator”). This Sweepstakes is not offered or sponsored in any way by Professional Golf Association, Inc. (“PGA”), PGA TOUR, Inc. or PGA TOUR Licensed Property, Inc. (collectively, the “PGA Entities”). Entrant irrevocably waives all claims against the PGA Entities and agrees that the PGA Entities will have no liability or responsibility for any claim arising in connection with participation in this Sweepstakes or any prizes awarded.
SWEEPSTAKES PERIOD: The Wyndham Rewards Points Giveaway (the “Sweepstakes”) consists of one (1) entry period on August 6, 2022, beginning at 12:00 p.m. Eastern Time (“ET”) and ending at the earlier to occur of (a) the time at which 5,000 potential First Prize Winners have been identified; and (b)11:59:59 p.m. ET (the “Sweepstakes Period”):
ELIGIBILITY: Open to legal residents of the fifty (50) United States, the District of Columbia and Puerto Rico who are at least 18 years of age (19 in Alabama and Nebraska, 21 in Mississippi) at time of entry (the “Entrant”). Void where prohibited and restricted by law. Sweepstakes is subject to all applicable federal, state and local laws.
HOW TO ENTER: During the Sweepstakes Period, you can enter the Sweepstakes by visiting: www.Wyndhamrewards.com (the “Site”) and completing and submitting the registration form as directed by providing a valid email address, creating a username with secure password and providing the correct answer to the question to receive one (1) entry (an “Entry”). At the start of Sweepstakes Period, if you spot one of the three (3) sand sculptures, you must select the hole from the drop-down menu where you spotted the sand sculpture in order to gain an Entry. If you are one (1) of the first five thousand (5,000) eligible Entrants during the Sweepstakes Period to submit an eligible Entry, you will be eligible to receive a prize, as outlined below. Limit one (1) Entry per person during the Sweepstakes Period. Any Entry not in compliance with the above and does not meet the entry requirements of these Official Rules will be disqualified. In the event that multiple accounts are used by the same person, all Entries submitted by such person are subject to disqualification. As applicable, normal Internet/phone access and usage/data charges imposed by Entrants’ online/mobile service will apply. See your internet/wireless provider for pricing plan details. Entries become the property of the Sponsor and will not be acknowledged or returned. Automated, script, macro or robotic entries will be disqualified.
DETERMINATION OF WINNERS/WINNERS NOTIFICATION: During the Sweepstakes Period, if you are one (1) of the first five thousand (5,000) to complete the online registration and answer the question correctly, you will be deemed a potential First Prize Winner. All potential First Prize Winners will be entered into a drawing to be conducted on or about August 9, 2022, during which one (1) potential Grand Prize winner will be randomly selected. The random drawing will be conducted under the direction of the Administrator. Administrator’s and Sponsor’s decisions are final and binding on the matters relating to this Sweepstakes. Potential winners will be notified via email within seven (7) to ten (10) days of random drawing date. Potential winners will be required to verify their eligibility by completing a Prize Acceptance form; potential Grand Prize winner will be required to complete an Affidavit and Declaration of Compliance, Liability Waiver, and a publicity release, to the extent permitted by law (collectively, the “Declaration”) and submit the Declaration to the Administrator via Docusign within forty-eight (48) hours of notification. Noncompliance with the times frame and/or with these Official Rules, Sponsor’s or Administrator’s inability to contact potential winners’ will result in disqualification and at Sponsor’s discretion, the prize maybe awarded to an alternate Entrant.
Prize recipient determination will be made by Sponsor, whose decisions are final in all matters relating to the Sweepstakes. Odds of receiving a prize depend on the time/date an eligible Entrant enters and the total number of eligible Entries received during the Sweepstakes Period. All prizes will be awarded provided a sufficient number of eligible Entries are received during the Sweepstakes Period.
PRIZES & APPROXIMATE RETAIL VALUE (“ARV”): Five thousand (5,000) First Prize Winners: Each prize consists of three thousand (3,000) Wyndham Rewards points. ARV of each prize: $39.00. Total ARV For All First Prizes To Be Awarded: $195,000; One (1) Grand Prize Winner: consisting of one million (1,000,000) Wyndham Rewards points; total ARV for Grand Prize: $13,000. TOTAL ARV FOR ALL PRIZES: $208,000. Winners must be or become a Wyndham Rewards member in order to receive Wyndham Rewards points awarded. The Wyndham Rewards loyalty program is free to join and open to individuals 18 years or older (for clarity, excluding minors). To join and for terms and conditions of the program, go to http://wyndhamrewards.com/terms. Membership in the Wyndham Rewards program, and use and maintenance of points awarded in this Sweepstakes, will be governed by such terms and conditions, as the same may be amended from time to time. Winners will receive an email from Wyndham Rewards within 7 to 10 business days following the conclusion of the Wyndham Championship, a PGA TOUR event, with a unique link redeemable for the designated number of Wyndham Rewards points awarded. Points must be claimed by October 31, 2022. Wyndham Rewards redemption levels and merchandise are subject to change and are maintained exclusively by Wyndham Rewards. Wyndham Rewards Points unique link is not redeemable for cash. Limit one (1) First Prize per person during the Sweepstakes Period. The maximum number of Wyndham Rewards points an Entrant can win is three thousand (3,000), unless they win the Grand Prize.
GENERAL RULES: The Site’s computer timestamp is the official timekeeper for purposes of this Sweepstakes. Return of prize or prize notification as undeliverable or failure to reply to potential prize winner notification may result in disqualification and alternate potential prize recipient may be selected. Prizes are non-transferable and no substitutions (cash or otherwise) are allowed (except by Sponsor at its sole discretion). Prizes may be substituted for any reason at the discretion of the Sponsor. Prize recipients will be responsible for any other costs or expenses associated with the prize, including payment of applicable taxes. Acceptance of prize constitutes permission to use prize recipients’ name, username, photograph, voice, statements, and/or other likeness for promotional purposes without further compensation except to the extent prohibited by law. Prize recipients, by accepting a prize and all Entrants, as a condition of Entry, agree, as applicable, to release and hold harmless Sponsor, Administrator, Wyndham Rewards, Inc. Wyndham Hotels & Resorts, Inc., Wyndham Destinations, Inc.,the PGA Entities, Sedgefield Country Club, and each of their respective parent companies, affiliates, subsidiaries, advertising and promotion agencies, and their respective officers, directors, shareholders, members, employees, agents, assigns, and all others associated with the development and execution of the Sweepstakes, from and against any and all liability, claims or actions of any kind whatsoever, for injuries, death, damages, or losses to persons or property which may be sustained in connection with submitting an Entry or otherwise participating in any aspect of the Sweepstakes, the receipt, ownership or use of prize awarded, or while preparing for, participating in or from any prize-related activity or for any typographical or other error in these Official Rules or the announcement or offering of the prizes. The Sponsor is not responsible if any prize cannot be awarded or Sweepstakes cannot run as planned due to cancellations, delays, or interruptions due to acts of God, acts of war, natural disasters, epidemics (including, without limitation, the current COVID-19 pandemic and Monkeypox outbreak), weather, threat of terrorism or terrorism. Further, Entrant agrees that legal action cannot be pursued as a result of such cancellations, delays, or interruptions. In case of dispute, Entries will be declared to be made by the authorized account holder of the e-mail address submitted at the time of Entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, Online Service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes; violates these Official Rules; acts in an unsportsmanlike or disruptive manner: or acts with intent to annoy, abuse, threaten or harass any other person. Sponsor is not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender, by any of the equipment or programming associated with or utilized in the Sweepstakes which may limit the ability to participate, or by any human error which may occur in the processing of the Entries and administration of the Sweepstakes. Sponsor reserves the right to cancel, terminate or modify the Sweepstakes if it cannot be completed as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or corruption of any sort. In such event, Sponsor will award such number of prizes that have been earned in accordance with these Official Rules (if any) up until time of cancellation.
ENTRANTS’ PERSONAL INFORMATION: The information that you provide in connection with the Sweepstakes may be used by Sponsor in accordance with its Privacy Notice, which may be updated from time to time without notice.
DISPUTES: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of Entrants and Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s or jurisdiction’s laws. By participating in the Sweepstakes, Entrant agrees that: (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, shall be resolved individually without resort to any form of class action; (ii) any judicial proceeding shall take place in a federal or state court within the State of New Jersey; (iii) any and all claims, judgments , and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event will attorney fees be awarded or recoverable; (iv) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to seek, punitive, incidental, exemplary, consequential, special damages, lost profits, other damages, and/or any rights to have damages multiplied or otherwise increased; and (v) Entrant’s remedies are limited to a claim for money damages (if any) and he/she waives any right to seek injunctive or equitable relief.
SEVERABILITY: The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, the other provisions will remain in effect and will be construed as if the invalid or unenforceable provision were not contained herein.
MISCELLANEOUS: These Official Rules contain the full and complete understanding with respect to the Sweepstakes and supersede all prior and contemporaneous agreements, representations and understandings, whether oral or written. The headings herein are for convenience only, do not constitute a part of these Official Rules, and shall not be deemed to limit or affect any of the provisions hereof. No amendment to, or waiver of, any provision of these Official Rules shall be effective unless in writing and signed by Sponsor. The waiver by Sponsor of any provision of these Official Rules shall not constitute a waiver of any other provision herein. The rights and obligations hereunder may not be assigned by Entrant, whether by operation of law or otherwise, without the prior written consent of Sponsor, and any attempted assignment in violation of the foregoing shall be null and void. These Official Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of Sponsor and Entrant.
