This Prize Draw is sponsored by Wyndham Rewards, Inc., 22 Sylvan Way, Parsippany, New Jersey 07054 (the “Sponsor”) and administered by Berlin Productions, Inc., 870 Locke Ln., Yorktown Heights, New York 10598 (the “Administrator”). Both Sponsor and Administrator are incorporated under state laws of the United States of America.

These are the terms and conditions (the “Official Rules”) that govern the relationship between entrants and the Sponsor in respect of this Prize Draw. These Official Rules can be found at the Website (defined in Rule 2 below). By entering this Prize Draw, each entrant confirms that it has legal capacity to enter this Prize Draw.

NO PURCHASE NECESSARY.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  SUBJECT TO ALL FEDERAL, STATE, PROVINCIAL AND LOCAL LAWS, REGULATIONS, AND ORDINANCES.   The 2023 Wyndham Rewards Member Month Europe and the Middle East Prize Draw (“Prize Draw”) begins 8:00:00 AM, United States Eastern Daylight Time (“ET”) on March 15, 2023 and ends at 11:59:59 PM (ET) on March 31, 2023 (“Prize Draw Period”). The Sponsor’s computer (located in the United States of America) is the official time-keeping device for this Prize Draw. Please visit http://www.worldtimeserver.com/ or other world time database to determine local time.

1.   Eligibility. This Prize Draw is open to residents of France, Germany, India, the Netherlands, Switzerland, United Arab Emirates and/or the United Kingdom, who, as of the commencement of the Prize Draw Period are at least eighteen (18) years of age, or the age of majority in their jurisdiction of residence (whichever is greater) and who have internet access and a valid and active email account. Employees, officers and directors of  (a) Sponsor and the Administrator, (b) the parents, affiliates, subsidiaries, franchisees, representatives, consultants, contractors, legal counsel, advertising, public relations, advertising, promotional and fulfillment agencies, web site providers, web masters of each of the Sponsor and the Administrator, and (c) the immediate family (defined as parents, spouse, children, siblings, regardless of where they live) and household members of each such employee, officer and director, are not eligible to enter or win.  Participation constitutes entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s and the Administrator’s decisions, which are final and binding in all matters related to the Prize Draw. Winning a prize is contingent upon fulfilling all requirements set forth herein.

An entrant is not a winner of any prize unless and until entrant’s eligibility has been verified and entrant has fully complied with these Official Rules and he/she has been notified by Sponsor or its authorized agent to such effect.

2. How to Enter.  During the Prize Draw Period, eligible individuals may enter by registering on designated website ( https://www.wyndhamhotels.com/en-uk/wyndham-rewards/hotel-deals/points-giveaway (the "Website"); If entrant is not a Wyndham Rewards member at time of registration, they will have the option to join the Wyndham Rewards program prior to entry, or enter without becoming a Wyndham Rewards member by sending an email containing their name, address of residence, and phone number to MemberMonthGiveaway@wyndham.com. The Wyndham Rewards Program is free to join and membership is subject to the Wyndham Rewards Terms and Conditions, Privacy Notice and additional Privacy Disclosures.  There is a limit of one (1) entry per eligible individual.  Any attempt by any entrant to submit multiple entries by using multiple and/or different identities or any other method will void all of that entrant's entries and that entrant will be disqualified.  Multiple entrants are not permitted to share the same profile or to submit a shared entry. Standard data rates may apply for entrants using their mobile device. Proof of submitting an entry will not be deemed to be proof of receipt.  Sponsor and its agencies are not responsible for late, lost, undecipherable, incomplete or invalid entries, which will be disqualified. 

3.  Selection and Verification of Winners. Twenty three (23) potential winners will be selected by the Administrator from among all eligible entries to the 2023 Wyndham Rewards® Member Month Europe and Middle East Prize Draw received during the Prize Draw Period in a random electronic drawing to be conducted on or about April 7, 2023.  Subject to these Official Rules, each verified winner will receive the prize more particularly described in Section 4 below.

On or about April 7, 2023, each potential Prize Draw prize winner will be notified by a prize notification email (“Prize Notification”) sent to the e-mail address such potential winner has on file with Wyndham Rewards (such person’s “Wyndham Rewards Email Account”), or the email address provided by entering via email entrance to MemberMonthGiveaway@wyndham.com. Prize will be awarded to each verified winner on or about April 30, 2023.

In the event that a potential prize winner cannot be contacted as described above by April 14, 2023, or Prize Notification or prize is returned as undeliverable, or a potential prize winner is disqualified for breaching these Official Rules, potential winner will forfeit his/her prize. In all cases of prize forfeiture/disqualification, potential winner/entrant will NOT receive compensation of any kind and an alternate winner will be selected in a subsequent random electronic drawing from all remaining eligible entries received. 

Odds of winning a prize depends on the number of eligible entries received during the Prize Draw Period.

All entrants selected in the Prize Draw are subject to verification of eligibility and compliance with the terms of these Official Rules.

4. Prize Draw Prizes

Twenty-three (23) winners will each receive forty-five thousand (45,000) Wyndham Rewards points in the form of a “points pack” to be delivered via email.  Points pack expires and points must be claimed by recipient by deadline set forth on points pack or in the email via which it is delivered.  Approximate retail value (“ARV”) of each prize: £305.26, €346.47 (based on exchange rate as of March 13, 2023). There is no cash alternative for the prize; however, the Sponsor and Administrator reserve the right to substitute the prize with a voucher for one (1) free night at the Hotel by Wyndham (of equal or greater value to the original prize; if winner is a resident of the Netherlands, such voucher shall be valid for at least two [2] years from date of issuance). All use of points and vouchers are subject to booking availability and other restrictions.  The transportation costs to come to the hotel chosen by the winner, and more generally all other associated costs to benefit from the Prize will be borne by the winner.

TOTAL ARV OF ALL PRIZES: £7020.95, €7968.70 (based on exchange rate as of March 13, 2023).

Limit: one (1) prize per verified winner.

5. General Conditions.  If, for any reason, the Prize Draw is not capable of running as planned, Sponsor may, in its sole discretion, void any suspect entries and, in exceptional circumstances, modify the Prize Draw or suspend the Prize Draw to address the impairment and then resume the Prize Draw in a manner that best conforms to the spirit of these Official Rules. In such event, Sponsor will provide details of the supplemental or amended Official Rules on the Website.  Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be attempting to tamper with or undermine the entry process and/or the legitimate operation of this Prize Draw or to be acting in violation of these Official Rules or in a disruptive or unsportsmanlike manner or with the intent to annoy, abuse, threaten or harass any other person; to the extent allowed by law, an individual so affected may seek an explanation of such determination from Sponsor. Any attempt by any person to deliberately interfere with the legitimate operation of this Prize Draw may be a violation of criminal and civil laws and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law (as well as disqualifying such individual, if appropriate).  Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.  These Official Rules may not be published elsewhere without the express written consent of Sponsor, which may be withheld for any reason.

6. Publicity.  EXCEPT TO THE EXTENT PROHIBITED BY LAW, PARTICIPATION IN THE PROMOTION CONSTITUTES EACH WINNER’S GRANT TO SPONSOR (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR), ITS PARENTS, SUBSIDIARIES, AFFILIATES, FRANCHISEES, ADVERTISING AND PROMOTION AGENCIES, AND THOSE ACTING PURSUANT TO ITS AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, EACH WINNER’S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, OPINIONS AND BIOGRAPHICAL INFORMATION (INCLUDING BUT NOT LIMITED TO HOMETOWN AND STATE) FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST), SOLELY IN CONNECTION WITH THE PRIZE DRAW WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION.  For entrants from france, GERMANY, The netherlands, SWITZERLAND AND THE UNITED ARAB EMIRATES: the lack of consent to this GRANT OF RIGHTS will not prevent the winner from being awarded the Prize.

7. Release and Limitations of Liability. By participating in this Prize Draw, entrants agree to release and hold harmless to the maximum extent permitted by the applicable law, the Administrator, Sponsor, its marketing agencies, and their  respective parents, affiliates, subsidiaries, franchisees, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional and prize fulfillment agencies, prize suppliers and each of their respective officers, directors, employees, shareholders, representatives, successors, assigns and agents (“Released Parties”), from and against any claim or cause of action arising out of participation in the Prize Draw or receipt or use or misuse of any prize.

The Released Parties are not responsible for, and entrant hereby releases Sponsor and all other Released Parties from any claims or causes of action arising from:  (1) incorrect or inaccurate transcription of entry information, winner verification information, or lost, stolen, illegible, incomplete, misdirected entries, or entries received through impermissible, unauthorized or illegitimate channels, all of which will be disqualified; (2) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer, network, hardware or software; (3) unauthorized human intervention in any part of the entry process or the Prize Draw and/or inaccurate or incomplete information being displayed in connection with the Prize Draw, whether due to unauthorized human intervention, equipment failure/malfunction or other cause; (4) electronic or human error which may occur in the administration of the Prize Draw or the processing of entries; (5) any injury or damage to persons or property, which may be caused, directly or indirectly, in whole or in part, by entrant’s participation in the Prize Draw.

BY PARTICIPATING IN THIS PRIZE DRAW, ENTRANT AGREES THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE LOSSES OR DAMAGES [TO THE EXTENT AVAILABLE UNDER APPLICABLE LAW]) TO PERSONS (INCLUDING, WITHOUT LIMITATION, PERSONAL INJURY OR DEATH), OR PROPERTY, IN EACH CASE, RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF A PRIZE, ENTRY, OR PARTICIPATION IN THIS PRIZE DRAW OR IN ANY PRIZE DRAW RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY.  THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS DUE TO ACTS OF GOD, PANDEMIC, ACTS OF WAR, NATURAL DISASTERS, WEATHER, TERRORISM OR ANY FAILURE IN PERFORMANCE THAT CANNOT BE ATTRIBUTED TO THE RELEASED PARTIES. 

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS PRIZE DRAW, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.  SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.  CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

UK – in respect of all provisions of this Rule 7, UK entrants shall retain their consumer rights and right to any action or damages in respect of the Released Parties' liability for death, personal injury, fraudulent misrepresentation and/or negligence.

FRANCE – in respect of all provisions of this Rule 7, the mandatory provisions of French consumer law will remain applicable.

GERMANY- in respect of all provisions of this Rule 7, the mandatory provisions of German consumer law will remain applicable and, without limitation, German entrants shall retain their consumer rights and right to any action or damages in respect of the Released Parties' liability for intentional or gross negligence.

INDIA – in respect of all provisions of this Rule 7, Indian entrants shall retain their consumer rights and right to any action or damages in respect of the Released Parties' liability for intentional or gross negligence or fraudulent misrepresentation.

THE NETHERLANDS- in respect of all provisions of this Rule 7, entrants from the Netherlands shall retain their consumer rights and right to any action or damages in respect of the Released Parties’ liability for gross negligence and/or willful misconduct.

SWITZERLAND – in respect of all provisions of this Rule 7, Swiss entrants shall retain their consumer rights and right to any action or damages in respect of the Released Parties’ liability for gross negligence and/or intentional misconduct.

8. Disputes. Without limiting any term or condition of these Official Rules, to the fullest extent permitted by law, entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Prize Draw or any prizes awarded shall be resolved individually, without resort to any form of class action, exclusively in the federal courts in the County of Morris, the State of New Jersey and entrant consents to the personal and exclusive jurisdiction of said courts and expressly waives any right of change of venue, forum non conveniens or any like right; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Prize Draw but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Subject to applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the rights and obligations of the entrants and Sponsor in connection with the Prize Draw and/or any such dispute/claim/cause of action shall be governed by and construed in accordance with the laws of the State of New Jersey with the sole exception of New Jersey law governing choice of law/conflict of laws.

UK – Rule 8 does not apply.  UK entrants shall have the right of recourse under English law.

france – Rule 8 does not apply.  The mandatory provisions of French consumer law remain applicable. French courts shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Prize Draw or these Official Rules.

GERMANY- Rule  8 does not apply.  German entrants shall have the right of recourse under German law.

INDIA- Rule  8 does not apply.  Indian entrants shall have the right of recourse under Indian law and agree that all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event will attorney’s fees or punitive, incidental, consequential, or any damages other than actual out-of-pocket expenses be awarded.

THE NETHERLANDS – Rule 8 does not apply. Entrants from the Netherlands shall have the right of recourse under Dutch law.

UNITED ARAB EMIRATES- Rule 8 does not apply. Entrants from the United Arab Emirates shall have the right of recourse under English law, with disputes to be resolved in the courts of the Dubai International Financial Centre.
